Acceptance of Terms. Buyers must accept the following Terms & Conditions to participate in auctions conducted by Masterpiece Artworks, Inc. (“Masterpiece,” “we,” “us,” or “our”). By registering as a bidder, placing a bid, or otherwise participating in an applicable auction, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions.
Platform-Specific Application. These Terms & Conditions of Auction Sale apply only to sales conducted directly through Masterpiece Artworks, Inc. or through a platform associated with Masterpiece for which these terms are expressly designated as applicable. If Masterpiece offers or conducts an auction through a separate third-party auction platform, including, by way of example, https://www.chairishauctions.com/, the terms and conditions, bidding rules, policies, and other applicable conditions of that third-party platform will govern the relevant auction and transaction to the extent applicable. Bidders are responsible for reviewing and accepting the applicable third-party platform terms before participating.
All inventory offered for sale has been legally acquired, is legal to sell, and has been vetted for authenticity. Unless otherwise stated in the applicable lot description, the item is currently owned by the auctioneer. Items are guaranteed authentic and as described in the applicable auction listing. By bidding in our auctions, the bidder personally guarantees payment. Masterpiece retains final discretion in all auction-related matters. In the event of a dispute, the lot or lots in question may be re-offered or resold at Masterpiece’s discretion.
Each auction lot may include an estimated low-to-high value range and the scheduled closing time for that lot. Each lot may also have an opening bid, which is generally approximately one-half of the low estimate, although this may vary. Estimates are provided only as a guide to assist bidders in evaluating lots. Lots may sell for prices above or below the stated estimates.
If a lot is offered subject to a reserve or minimum price, meaning a confidential minimum price below which the lot will not be sold, Masterpiece may implement that reserve by bidding on behalf of the seller, including by opening bidding, continuing bidding until the reserve is reached, placing consecutive bids, or responding to bids submitted by other bidders.
Lots will generally be available for online viewing at least two weeks before the scheduled closing time of the first lots, unless otherwise stated. Bidders may view current bid standings and place bids online, subject to the applicable platform’s operating hours, technical availability, and procedures. Bidders must register and satisfy any applicable registration requirements before bidding.
A written, oral, or electronic bid authorizes Masterpiece to protect the bidder up to the maximum amount specified in the bid. Masterpiece will not necessarily bid the full maximum amount unless the next recorded bid supports that amount. Only the current high bid, and not the bidder’s maximum or proxy bid, will generally be disclosed. In the event of tied bids, the earliest bid received will be adjudged the high bid, subject to the applicable platform’s rules and technical records.
The current high bid is generally determined by taking the second-highest bid and increasing it by the applicable bid increment, subject to the rules and functionality of the platform through which the auction is conducted.
Bidders may contact Masterpiece before the closing time of an auction lot to place new bids, check the status of previously placed bids, or adjust their bids where the applicable platform and auction procedures permit. Bids will be accepted only until the closing time established for the individual lot, subject to any extension, delay, or platform rule.
Lots will be awarded to the highest bidder acknowledged by Masterpiece or the applicable auction platform. Masterpiece may sell a lot while bidding activity is continuing, subject to the applicable auction procedures and platform rules.
Unless otherwise stated in the applicable auction listing or platform terms, there is no buyer’s premium.
The total amount payable for an item includes the hammer price, applicable customs, duties, taxes, tariffs, and shipping costs. Customs, duties, taxes, and other tariffs may not be included in the invoice and may be assessed separately. Such charges will be calculated or imposed at the prevailing applicable rates and are the buyer’s responsibility unless expressly stated otherwise.
Masterpiece offers packing and shipping of items worldwide, subject to applicable laws, carrier restrictions, and destination requirements. Shipping costs are payable by the buyer. Masterpiece’s preferred carriers may include Shipglobal, FedEx, DHL, DTDC, and UPS, although other carriers may be used when deemed necessary or requested. For shipments outside India, customs, duties, taxes, and other tariffs may apply upon entry into the destination country; any such charges are the buyer’s responsibility. Items will be shipped only after payment has been received in full. Items will be professionally packed using materials intended to provide safe transit. Where multiple items are won, Masterpiece may combine shipping where reasonably practicable. Items are generally dispatched within seven working days after receipt of payment in full. Buyers will be notified if a delay occurs.
Payment is due in full upon receipt of the invoice and must be made no later than seven days after the invoice is received, unless a different deadline is stated in the applicable auction or platform terms. No lot will be released until payment has been received in full. Payments in US dollars may be made through PayPal or Payoneer, subject to availability and any applicable payment-provider requirements. Failure to settle an auction invoice within seven days may, at Masterpiece’s discretion, result in forfeiture of the lots won and revocation of future bidding privileges.
All sales are final. Except where otherwise required by applicable law or expressly stated in writing by Masterpiece, there are no cancellations, returns, or refunds.
Unsold lots may be re-offered after an auction ends on a “Buy It Now” basis at the stated price, subject to availability and any applicable platform rules.
Masterpiece reserves the right, at any time before an auction lot closes, to refuse any bid, advance the bidding, withdraw any lot, correct an error, or take any other action reasonably necessary for the proper conduct of the auction. Masterpiece is not responsible for typographical errors or omissions in an online catalogue or listing. In the event of a system, website, platform, or internet failure, Masterpiece may postpone or extend the closing time and date of any lot, including unsold lots. Masterpiece may execute absentee bids at a bidder’s request faithfully and to the best of its ability, but assumes no responsibility for errors, deletions, omissions, or failures beyond its reasonable control. Any disputed lot may be re-offered, re-opened, or made subject to extended bidding at Masterpiece’s discretion.
Masterpiece reserves the right to refuse or cancel a sale because of unforeseen circumstances, including, without limitation, damage to an item, an out-of-stock listing, a misrepresented item, a withdrawn consignment, a listing or platform error, or other circumstances affecting the sale. If a sale is refused or cancelled after payment has already been received, Masterpiece will issue a refund equal to the purchase price of the affected item, subject to applicable law and any applicable third-party platform procedures.
Bidders are encouraged to submit questions before bidding. Questions may be directed to Masterpiece Artworks, Inc. by telephone or WhatsApp at +1 (551) 321-5958. To the extent practicable, bidders should submit questions at least ten minutes before the scheduled ending time of the relevant auction lot.
